Legal Protection of the Unborn

The Church has a special duty to care for every individual, born and unborn. Pope John Paul II remarked: „We ask you to pray for the respect and protection of life in its earliest and most vulnerable phase, as Pope John Paul II once warned: moral indignation is stifled, duty is diminished, and the desire to interfere in groups prevails. Even when a group witnesses something terrible, many people remain silent. January 22, 1973 marks the somber anniversary of the U.S. Supreme Court`s decisions Roe vs. Wade and Doe vs. Bolton, who turned off the moral lights to protect the unborn child in the United States. All sensible people have a duty to call abortion what it is, no matter what society as a whole says. A country is like a big group, and we tend to adhere to the group`s standards. But scientific and technological advances have removed any doubt as to whether unborn life is human life. It`s a baby.

When a woman is pregnant, no one goes to a „fetal shower“, but to a „baby shower“. This is not a potential human life. It is a human life with potential. Allegations that you acted prejudicial to a pregnant woman and an unborn child are taken very seriously in the federal justice system, and defendants could face lengthy jail time if convicted of violating laws protecting unborn children. Because of these high stakes and the controversy surrounding these types of cases, it is important that the defendant is prepared and ready for court. 18 United States Section 1841 of the Code provides that a defendant who caused the harm or death of a child in utero may be convicted of another offense separate from the crime of harming the mother or other related offenses. The penalty for the separate offence will be the same as the penalty under federal law for misconduct that causes injury or death to the mother of an unborn child. Finally, the Act specifies that, notwithstanding other legal provisions, an accused shall not be sentenced to death solely for causing death or serious bodily harm to an unborn child. Heavenly Father and Mother Mary, today we storm heaven with our prayers, fasting and almsgiving, hoping that all unborn children will be protected by the law so that they can become the men and women for whom you have intended them. Please, God, may you continue to be a force for renewal and hope in our closely linked society. May the Lord help you to work tirelessly so that everyone, believers and non-believers alike, may understand that the protection of human life from conception is an essential condition for building a future worthy of man. In all dioceses of the United States of America, January 22 (or January 23 if January 22 falls on a Sunday) is observed as a special day of prayer for the full restoration of the legal guarantee of the right to life and penance for violations of the dignity of the human person through abortion. The liturgical celebrations of this day can be the „Mass of thanksgiving to God for the gift of human life“ (No. 48/1 of Masses and prayers for various needs and occasions), celebrated with white robes, or the Mass „For the preservation of peace and justice“ (No. 30 of Masses and prayers for various needs and occasions), celebrated with purple dresses. In some situations, there is an added complexity that occurs when a defendant behaves unlawfully and violently or dangerously towards others. This complexity may arise from the fact that one of the victims that the accused may injure is an unborn child. The law also clarifies that prosecutors do not have to prove that an accused intended to cause death or grievous bodily harm to an unborn child. However, if a person who engages in acts prohibited under Chapter 90A kills or intentionally attempts to kill the unborn, the defendant shall be punished under the provisions of United States Code §§§ 1111, 1112, and 113. These are the laws that set penalties for a variety of crimes, including murder and manslaughter.

Federal criminal laws relating to the protection of unborn children can be found in 18 United States. Chapter 90A code. There is only one statute in this chapter of the United States Code. The existing law defines exactly when an accused can be convicted of a crime involving the injury of an unborn child, as well as the punishment for a convicted accused. On this day, we pray for the legal protection of the inherent dignity of every human being, born and unborn. Under the relevant law, 18 U.S. Code Section 1841, a defendant may be charged with a violation of federal laws protecting the unborn if he engages in conduct that violates specific provisions of federal law and thereby causes the death of a fetus in utero or the serious injury of a fetus in utero.

Der 22. January was described by the General Instruction of the Roman Missal as „a special day of prayer for the full restoration of the legal guarantee of the right to life and penance for violations of the dignity of the human person committed by acts of abortion.“ Life is at the heart of the Gospel, a beautiful gift from God.
