Legal Age to Buy Cigarettes in Wisconsin

The minimum age to buy tobacco is 21, although Wisconsin law still states that the legal age to buy tobacco is 18. Rep. John Spiros (R-Marshfield) drafted a bipartisan bill in its early days that would raise Wisconsin`s legal age to buy tobacco to 21. Rep. Spiros says it`s both a matter of enforcement and money. Under the bill passed Wednesday, no one can sue arms or ammunition manufacturers for damages related to the legal development, marketing or illegal use of their products. On December 20, 2019, the President signed a law amending the Federal Law on Food, Medicines and Cosmetics and raising the minimum age for the sale of tobacco products from 18 to 21. This law (known as „Tobacco 21“ or „T21“) came into effect immediately, and it is now illegal for a retailer to sell tobacco products – including cigarettes, cigars and e-cigarettes – to anyone under the age of 21. The new federal minimum age applies to all retail establishments and to persons without exception.

On December 20, 2019, the President signed a law amending the Federal Law on Food, Pharmaceuticals and Cosmetics to raise the minimum age for the sale of tobacco products from 18 to 21. This law (known as tobacco 21 or T21) came into force immediately. It is illegal for a retailer to sell tobacco products, including cigarettes, cigars and e-cigarettes, to anyone under the age of 21. There are no exceptions to this requirement. The FDA will continue to conduct compliance verification inspections of tobacco retailers to determine whether a retailer is complying with federal laws and regulations, including Tobacco 21. The Wisconsin convention passed a Republican-drafted bill that would limit the legal liability of gun and ammunition manufacturers, which could protect them from large payments after a mass shooting. MILWAUKEE – It is illegal to sell tobacco to anyone in the United States. under 21 years of age.

However, a legal vacuum is throwing Wisconsin out of step with the rest of the country, rendering law enforcement powerless. Wisconsin law enforcement was also taken by surprise. Police enforce state laws, not federal laws, and the state`s legal age to purchase tobacco remains unchanged. The FDA`s searchable inspection database shows that the City of Milwaukee, WI (excluding surrounding communities) conducted 63 inspections with a minor (a person under the legal age to purchase tobacco products) with decision data from 12/20/2019 to 5/31/2021. It is important to note that the date of the decision does not coincide with the date of the inspection. During the same period, there were 20 inspections with decision data that resulted in a warning letter or civil fine. The state Assembly was set Wednesday to pass a Republican-drafted bill that would limit the legal liability of gun and ammunition manufacturers. This means that it is up to retailers to monitor themselves. „$2.7 million a year that we could lose in federal funds if we don`t,“ Spiros said. „I`m optimistic that it will be finished and it will be finished.“ Supporters of the law include Wisconsin Gun Owners Inc. and the Firearm Industry Trade Association.

Democratic Gov. Tony Evers will almost certainly veto the measure. In the summer of 2019, the FDA released the Digital Age Verification Schedule as part of the voluntary „This is Our Watch“ retail education program. Retailers using the FDA`s „This is Our Watch“ digital age verification calendar can update the minimum age of purchase in the calendar to 21. Retailers who want a „This Is Our Watch“ digital age verification schedule can order one for free from the FDA`s Center for Tobacco Products Exchange Lab. „They always identify them because they look like they`re under 30. Sometimes I`m surprised the person might be 30, but you`re still trying to make sure you`re doing everything you can because it`s a highly regulated, rigorously controlled, heavily taxed industry,“ Halvorson said. The FDA`s voluntary smartphone app, „FDA Age Calculator,“ can help retailers comply with federal, state, and local age restrictions for selling tobacco products. The „FDA age calculator“ allows retailers to use their personal smartphones to determine if a customer is old enough under federal law to purchase tobacco products. Retailers using the FDA`s Age Calculator app must update the age limit to 21 through the app`s settings. For instructions, see the app`s help function.

The federal law was changed in 2019 and Wisconsin retailers enforced the higher age limit. For this reason, the change in state law will have minimal impact on the amount of tax revenue coming into the state, according to Wisconsin tax officials. An FDA spokesperson confirmed in a statement: „During the COVID-19 pandemic, the agency ordered a partial work stoppage. We are working with our government partners to resume tobacco retail inspections. While local police can`t enforce federal law in Wisconsin, federal agents can. To ensure that those who sell tobacco actually check identification and do not sell to minors, the U.S. Food and Drug Administration performs stab surgeries and unannounced inspections. New Berlin police have arrested a suspect after several lawns and a squad car were damaged during a chase. As in some parts of the state, Tobacco World customers in Greenfield had to be 18 to buy cigars or tobacco until President Donald Trump signed a spending bill in December 2019.

Internally, an increase in the federal age for tobacco to 21 was introduced. This came as a surprise to many. Governor Tony Evers announced that the program, which provides rent and utility assistance to households affected by the pandemic, will begin covering internet costs for qualified households. „I had a number of people. I understand their reasoning, they were not grandfathers. It was like overnight that changed, but at the same time, my hands are tied, I can`t do anything anymore,“ said Tracey Halvorson, owner of Tobacco World LTD. It would be a crime to physically assault or threaten a health care worker, according to a bill to be passed by the Wisconsin convention on Wednesday. Another bill to be approved by the assembly Tuesday night would remove income limits and enrollment caps for the private school voucher program.
