The Executive Office for Immigration Review (EOIR), the Policy Office, the Office of Legal Access Programs (OLAP) manage the pro bono list of legal service providers or the „list“. The list is published quarterly (January, April, July and October). The list is at the heart of EOIR`s efforts to improve the scope and quality of representation before its lawyers, and it is an essential tool for informing individuals in proceedings before EOIR of the pro bono legal services available. The rules regarding qualified organizations, pro bono reference services, and lawyers to be added to the list can be found in the Code of Federal Regulations, 8 C.F.R. § 1003.61 et seq. (80 Fed. DACA was first introduced in the […] EROLD provides timely, accurate and comprehensive legal advice and operational advice to the Agency`s staff in support of ICE`s immigration enforcement and public security missions.

EROLD`s attorneys prepare legal opinions, review and draft guidelines, laws, regulations, and other documents for DHS, ICE, and OPLA leaders on the legal and policy aspects of the Immigration Enforcement Functions of the Office of Detention and Deportation (ERO), including: alternatives to incarceration, civil arrest and detention authorities, civil rights and disabilities, conditions of detention, detentions, expedited deportation procedures, family detention, fugitive operations, youth affairs, repatriation initiatives, 287(g) program and visa waiver program. EROLD also hosts the OPLA`s regulatory program and provides significant assistance to the Department of Justice in federal court litigation that affects ICE`s actions regarding its arrest, detention, and deportation agencies. EROLD also plays a critical role in verifying U.S. citizenship statements filed by individuals detained by ICE or otherwise targeted by ICE for law enforcement. On 1 October 2015, the Department amended the regulations of the former list of independent legal service providers under 8 C.F.R. § 1003.61 et seq. The amendments renamed the list to „Pro Bono Legal Service Providers List“ and significantly revised the requirements for adding providers to the list. Changes to the rule include: organizations and lawyers must provide at least 50 hours per year of pro bono legal services to each immigration court where they are on the list, and provide public comments on outstanding qualified applicants on the list; and a recertification of suppliers every 3 years from the date of approval on the list. DcLD defends the prerogatives and operational activities of the ECI, its budget and its staff by diligently representing the interests of the agency in civil litigation and ruling on administrative claims for crimes. DCLD`s attorneys act as the agency`s legal representatives and handle federal civil litigation filed against ICE and cases involving ICE actions/parties.

DcLD also advises ICE management and staff orally and in writing on potential litigation risks, represents ICE`s interests in litigation discussions with other DHS agencies and agencies, and resolves administrative claims for personal injury and property damage under the Federal Tort Claims Act.
